Terms of Service

Effective August 28, 2026

Image Depot is a new platform, currently in early access. Its operating legal entity is being formed at the time of writing; this document uses "Image Depot," "we," "us," and "our" to mean whoever operates imagedepot.net and photo-depot.net, and will be updated with the formal registered entity name once formation is complete.

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Image Depot's website, gallery-delivery software, and related services (the "Service"). By creating an account, joining the early-access waitlist, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. Who can use the Service

You must be at least 18 years old and able to form a binding contract to create a Studio Account. The Service is intended for photography businesses and professionals ("Studios"), not for members of the public browsing on their own behalf.

3. Your account

You're responsible for the accuracy of the information you give us, for keeping your password confidential, and for everything that happens under your account. Tell us right away if you suspect unauthorized access.

4. Your content

You keep ownership of every photo and file you upload ("Content"). By uploading Content, you grant Image Depot a limited license to store, process, and display it solely to provide the Service to you and the clients you choose to share it with. We don't use your Content for anything else -- no stock licensing, no training data, no marketing use without asking you first.

5. Your responsibility for what you upload

You are solely responsible for having every right, license, and consent needed to capture, upload, and distribute your Content -- including any consent required by law for photographing or publishing images of identifiable people, and any additional consent required when a photo's subject is a minor. Image Depot provides hosting and delivery infrastructure; we are not a party to, and don't review or approve, the photography arrangements between you and your own clients or subjects.

You won't upload Content that's illegal, infringes someone else's rights, or that you don't have permission to distribute.

6. Fees and payments

Image Depot is currently in early access and free to use. Paid plans, commission terms, and payout mechanics will be published here before they take effect, and using a paid feature after that point means you agree to those terms. We will never change what we charge an existing subscription without advance notice.

7. Data export

You can request a full export of your account's galleries and photo library at any time by contacting us. We don't hold your library hostage, and we won't archive or restrict access to it without telling you first.

8. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate an account that violates these Terms, but we'll make a reasonable effort to give you notice and a chance to export your Content first, except where we reasonably believe immediate action is necessary (for example, to prevent harm or address illegal content).

9. Service availability

We work to keep the Service reliable, but we don't guarantee it will be uninterrupted or error-free. The Service is provided "as is," without warranties of any kind, to the extent allowed by law.

10. Limitation of liability

To the extent allowed by law, Image Depot isn't liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

11. Indemnification

You agree to defend and indemnify Image Depot against claims arising from your Content or your violation of these Terms, including claims related to consent for photographing or distributing images of the people in your Content.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

13. Changes to these Terms

We may update these Terms as the Service grows. We'll post the updated version here with a new effective date, and for material changes, we'll make a reasonable effort to notify active accounts directly.
