School Data Terms
Effective Date: October 17, 2026 · Last updated: October 17, 2026These School Data Terms ("School Data Terms") are part of the Image Depot Terms of Service (see Section 25A). They apply to every School Program account and every Image Depot Student account. They are accepted by the teacher or instructor ("Instructor") on behalf of the school, district or program the Instructor represents ("School"), and they are accepted for each student the Instructor invites. If these School Data Terms and the Terms conflict about student information, these School Data Terms win.
1. Who agrees, and for whom
The School is the party to these School Data Terms. By accepting, the Instructor confirms that they are authorised to bind the School, and that the School wants Image Depot to host Student accounts for its students. A Student account is not a separate contract between Image Depot and a minor. A student 13 or older confirms their age and acknowledges the Terms and the Privacy Policy, and a student under 18 also has a parent or guardian asked to confirm the account.
2. Image Depot as a school official (FERPA)
The School decides whether any information in a Student account is an "education record" under the Family Educational Rights and Privacy Act (20 U.S.C. 1232g; 34 CFR Part 99). To the extent it is, Image Depot acts as a school official with a legitimate educational interest under 34 CFR 99.31(a)(1)(i)(B). That means Image Depot:
- performs an institutional service or function for which the School would otherwise use its own employees: hosting student photography portfolios for a school program
- is under the School's direct control, through the Instructor's account, as to the use and maintenance of student information
- uses personally identifiable student information only for the purposes in Section 3, and does not re-disclose it except as these terms or the law allow
3. What we use student information for, and what we do not
We use student information only to provide the Student and School Program service to the School and its students: the account, the portfolio, hosting the student's photographs, the Instructor's roster and controls, security and abuse prevention, support, and legal compliance. We do not:
- sell student information, or share it for targeted advertising
- use student information to build a profile of a student for any purpose other than the service
- use student photographs to train artificial intelligence models
- run AI jersey recognition on Student or School Program accounts, or send a student's support messages to an AI service
- disclose student information to a third party except to the sub-processors listed on the sub-processor page, to the School, with a parent's or student's consent, or as the law requires
A student's public portfolio shows a first name and last initial unless the student or the Instructor chooses to show the full name. The student's listing in the Student Directory is a separate choice.
4. What the School is responsible for
- The Instructor has the School's authority to accept these terms and to invite each student.
- The School has the parental and school permissions it needs for the students it invites, including for students under 18, and for photographs of other people that a student uploads.
- The Instructor invites only students 13 or older, and gives a parent or guardian's email address for each student under 18.
- The School gives any notice to students and parents that its own policies and the law require.
5. Access and records
While a student is enrolled, the Instructor has full access to the student's account. Actions an Instructor takes inside a student's account are recorded in an audit log. Image Depot staff access to student information is limited to named staff in defined roles who need it for their work, and is logged (Data Processing Agreement, Section 3).
6. Deletion
The School may ask us at any time to delete one student's account, or every Student account in its program, by emailing support@imagedepot.net from the Instructor's address. A parent or guardian of a student under 18 may also ask us. We begin deletion within 30 days of a request we have verified. Deleted photographs leave the recoverable trash after 30 days, and backups roll off on the schedule in the retention table of the Privacy Policy (Section 9). We keep only the records the law or our accounting requires us to keep, which are listed there. If the School closes its account, we treat that as a request to delete its students' accounts unless a student has already left the program and kept the account (Terms, Section 25A).
7. Security incidents
If we confirm a breach of security that exposes student information, we will tell the Instructor's account email without undue delay and, where we can, within 72 hours of confirming it, with what we know: what happened, which information and which students are affected, what we are doing and what we suggest the School does. We will keep the School updated and will help it with any notice it has to give to students, parents or authorities. The School decides who notifies students and parents unless the law requires us to do it ourselves. Texas law also sets outside deadlines for notifying the people affected (no later than 60 days after the breach is determined) and the Texas Attorney General (no later than 30 days, when 250 or more Texans are affected), and we meet them for information we hold for our own purposes.
8. Parents and guardians
A parent or guardian of a student under 18 may ask us to review, correct or delete the student's account information, or to close the account, as described in Terms Section 25A. We may involve the Instructor and the School.
9. Sub-processors and where information is processed
Image Depot uses the sub-processors listed on the sub-processor page and processes information in the United States. We will email the Instructor before a new sub-processor receives student information, as the Data Processing Agreement describes.
10. Changes and term
These School Data Terms last as long as the School Program account exists, and for as long after as we hold student information. Terms Section 36 governs changes: we will email the Instructor at least thirty (30) days before a material change takes effect, and the School may reject it by closing the account.
